When ordering Goods under the Framework Agreement the Council shall:

(a) send an Order to the Framework Supplier ranked first following the evaluation of its Tender;

(b) if the Framework Supplier who was ranked first is not able to provide the Goods or fails to respond within the timeframe set out in the Order, the Council shall send an Order to the Framework Supplier ranked second;

The price for the Goods shall be based on the Framework Prices.
