The works, supplies or services can be provided only by a particular economic operator for the following reason: absence of competition for technical reasons
Explanation
The contract relates to the provision of Gartner Research Services, including access to Gartner's proprietary research, advisory services, benchmarking tools, analyst expertise and intellectual property. These services are unique to Gartner UK Limited and are protected by intellectual property rights that cannot be provided by alternative suppliers.
The Health Board requires continued access to Gartner's established research platform and advisory services to support digital strategy, cyber security, information governance, infrastructure planning, technology investment decisions and organisational transformation activities. The Gartner methodologies, benchmarking datasets, analyst network and subscription services are proprietary and not replicable by other economic operators.
Following assessment of the requirement, it was concluded that competition is absent for technical and intellectual property reasons, and that the required services can only be supplied by Gartner UK Limited. The award was therefore undertaken through a direct call-off under the relevant framework arrangement in accordance with the applicable procurement rules.
