The Trust is conducting a procurement exercise to establish a Trust specific framework agreement for the supply of Laparoscopic & Endo Mechanical products. The Trust reserves the right to accept an offer either in part or in full. The Trust also reserves the right not to award. In the event of an award not being made, bidders have no right to recompense.

Total quantity or scopeThe Authority is conducting a procurement exercise to establish a Trust specific Framework Agreement for the supply of Laparoscopic & Endo Mechanical Products. It is the Authority's intention to award 5 lots. Suppliers can apply for individual or all lots. The contract will be for a 4 year period, when the framework has been awarded direct call off will be established for 12 month periods, pricing will be held for a minimum period of 12 months. The main criteria for award of product will be Clinical preference. During the 12 month period of contract award Suppliers on the Framework who have not been awarded a basket of goods will have the opportunity to discuss the introduction of their products to the Framework with Clinicians prior to the next 12 months award being made. Product evaluations may be conducted during this process.
Criteria for inclusion on the Framework will be fulfilling the Technical & Service Requirements as detailed in the PQQ and the ITT. |

In accordance with Articles 45 to 50 of Directive 2004/18/EC and Regulations 23 to 25 of the Public Contracts Regulations 2006. Objective criteria for choosing the limited number of candidates
The PQQ sets out the information which is required by the Contracting Authority in order to assess the suitability of potential providers in terms of its technical knowledge and experience, capability/capacity, organisational and financial standing to meet the requirement.
During the PQQ stage, the intention is to short list to a maximum of 16 potential providers. The highest scoring potential providers will be invited to submit the formal Invitation to Tender (ITT).

Lodging of appeals
The contracting authority will incorporate a standstill period at the point information on the award of the contract is communicated to tenderers. That notification will provide full information on the award decision. The standstill period, which will be for a minimum of 10 calendar days, provides time for unsuccessful tenderers to challenge the award decision before the contract is entered into.
The Public Contracts Regulations 2006 (SI 2006/5) provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the Regulations to take action in the High Court (England, Wales and Northern Ireland).
