Explanation
The UK Ministry of Defence (Defence Equipment and Support, Fast Air Support Team) (the Authority) is intending to enter into a new 3 year contract replacing Contract TORSPT3/4032 due to expire on 31.12.2015. This new contract is for the ongoing maintenance and support of Tornado aircraft rigs, namely the Avionics Ground Training Rig, the In-service Software Maintenance Facility and the Computer Symbol Generator Stage 2 rig (the New Contract).
It is considered that the New Contract can be entered into using the negotiated procedure without prior publication pursuant to Article 28(1)(e) of Directive 2009/81/EC of the European Parliament and of the Council (Regulation 16(1)(a)(ii) of the UK Defence and Security Public Contracts Regulations 2011) for technical reasons.
BAE Systems Ltd (BAE), the economic operator to whom the UK Ministry of Defence intends to award the New Contract, is the UK Ministry of Defence's nominated Prime Contractor and Design Organisation for its military fleet of Tornado aircraft and weapon systems. BAE designed and installed the 3 Tornado software support rigs in 1995 and has subsequently provided technical upgrades and modifications to ensure that the rigs remain up to date and serviceable. BAE is accordingly the only economic operator with the specific know-how, tools and data required to meet the Authority's operational service requirements under the New Contract.
