Award of a contract without prior publication of a call for competition
Justification for selected award procedure:
The works, supplies or services can be provided only by a particular economic operator for the following reason: absence of competition for technical reasons
Explanation
It is considered that this contract can be awarded using the Negotiated Procedure without prior publication of a contract notice pursuant to Article 28(1)(e) of the Directive 2009/81/EC of the European Parliament and of the Council (Regulation 16(1)(a)(ii) of the UK Defence and Security Public Contracts Regulations 2011) for technical reasons. This is because only Selex has the requisite knowledge of the OMDET, a software tool that is used to evaluate the effectiveness of the Electronic Support Measures (ESM) Mission Data. Selex ES Ltd qualify the software tool and certify the safety and conformance of the software which is required to be interoperable with the current Typhoon Defensive Aids Sub-System, (DASS). No other product provides this level of interoperability and therefore Selex is the only economic operator who can meet this requirement.
