Abstract

This contract is for High Peak Borough Council to appoint a single contractor for the provision of a management operating contract covering leisure facilities, maintenance and associated centre based activity programming in the High Peak region; i.e. in Buxton, Glossop and New Mills Leisure Facilities.

The contract will include additional requirements for Utilities, Capital Construction works (Design and Project Management) and Grounds maintenance responsibilities at leisure sites.

The Council owns 4 Leisure sites across High Peak:

— Buxton Swimming and Fitness Centre, St John's Road, Buxton, SK17 6BE,

— Glossop Leisure Centre, High Street East, Glossop, SK13 8PN,

— Glossop Swimming Pool, Dinting Road, Glossop, SK13 7DS,

— New Mills Leisure Centre, Hyde Bank Road, New Mills, High Peak, SK22 4BP.

In addition there are the following grass pitches to manage and maintain:

— Cote Heath, Heath grove, Buxton, SK13 7AR (1 adult pitch has potential for 2),

— Pyegrove, Pyegrove Road, Glossop, SK13 8QS (2 adult pitches),

— Newshaw Lane, Newshaw Lane, Hadfield, SK13 2AY (1 adult pitch),

— Memorial Park, Reservoir Road, Whaley Bridge SK23 7BL (1 adult/1 junior pitch* under a joint arrangement with Football club).

The Facilities across the locations, host a mixture of activities and fixed equipment including for example:

— Sports Hall multi-use, Swimming pools, Fitness Suites, Dance Studios, Squash Courts, outdoor hard Courts, Athletics and Cycle Track and Grass pitches.

The current arrangements are outsourced to an Economic Operator under contract, with the arrangement due to expire 31.3.2019. The renewed contract will commence 1.4.2019 until expiry 31.3.2024.

High Peak Borough Council is currently considering its longer term options for future provision of sport and leisure facilities, this contract would be in place to continue the provision of services whilst future Leisure, Health and Sports strategies are being developed.

This procurement is issued under an Open OJEU Procedure under Section 7 of the Public Contracts Regulations 2015.

The form of contract will be based on the Sport England standard leisure operating contract as amended to take into account the specific requirements of the opportunity. The operator partner will deliver the Council's Priority Outcomes for health and well-being against the Council’s Corporate Plan objectives.

High Peak Borough Council wish to appoint a suitably experienced and competent Leisure operator to deliver leisure services and activities at the Council's Leisure sites to the local and extended communities. We are inviting proposals through an Open tender compliant under Section 7 of the Public Contracts Regulations 2015, to secure a 5 year contract for this service. In addition to the operation of the Leisure centres, there will be a requirement for the operator to lead on capital works projects at the various sites and grounds maintenance responsibilities.

He Council will incorporate a minimum 10 calendar day standstill period at the point information on the award of the Contract(s) is communicated to Bidders. Bidders or Applicants who are unsuccessful shall be informed by the Council as soon as possible after the decision has been made as to the reasons why the Bidder/Applicant was unsuccessful. If an appeal regarding the award of the Contract(s) has not been successfully resolved, The Public Contracts Regulations 2015 (SI 2015 No. 102) provide for aggrieved parties who have been harmed or are at risk of harm by breach of the rules to take legal action. Any such action must be brought within the applicable limitation period. Where the Contract(s) has not been entered into, the Court may order the setting aside of the award decision or order the Council to amend any document and may award damages. If the Contract(s) has been entered into the Court may, depending on the circumstances, award damages, make a declaration of ineffectiveness, order the Council to pay a fine, and/or order that the duration of the contract(s) be shortened. The purpose of the standstill period referred to above is to allow the parties to apply to the Courts to set aside the award decision before the Contract(s) is entered into.
