Explanation
This procurement has been conducted pursuant to Directive 2014/24/EU of the European Parliament and of the Council. Article 32, 3(b) — Negotiated procedure without prior publication.
(3) The negotiated procedure without prior publication may be used for public supply contracts—
(b) for additional deliveries by the original supplier which are intended either as a partial replacement of supplies or installations or as the extension of existing supplies or installations where a change of supplier would oblige the contracting authority to acquire supplies having different technical characteristics which would result in incompatibility or disproportionate technical difficulties in operation and maintenance.
Explanation:
Oracle e-Business Suite is The Guinness Partnership's core corporate business system. Oracle has advised that the current version comes to end-of-life in December 2021, requiring investment in upgrade and refresh to stay with the current system. Guinness therefore needs to upgrade its core finance, procurement and business Intelligence functions from its own premise Oracle e-Business System to a Cloud based system. Oracle’s Software as a Service (SaaS) financials, resource planning and other technology components have been selected as providing the best way forward to both replicate current facilities and provide a basis for transformation.
The Guinness Partnership Ltd has been using Oracle systems for a number of years and as such has invested a large amount of finance and resource into operating the software and systems. Moving away from Oracle would therefore cause disproportionate technical difficulties, and the cost of moving to a different system would be prohibitively high. Guinness needs to invest in upgrading the system, in order to future proof business critical systems, therefore Guinness has decided to move to Oracle’s latest product, Fusion Cloud, as the extension of existing supplies and partial replacement of supplies from the original supplier.
