Section IV: Procedure
IV.1) Description
IV.1.1) Type of procedure
Award of a contract without prior publication of a call for competition
Justification for selected award procedure:
The services can be provided only by a particular economic operator for the following reason: absence of competition for technical reasons
Explanation
Recognising its obligations and responsibilities under the NHS (Procurement Patient Choice and Competition)(No 2) Regulations 2013, the contracting authority has assessed this provider to be the only technically capable provider, able to mobilise and scale up to pilot a new approach to intervention, having the expert track record and experience considered critical to deliver this innovative programme of healthcare intervention. The contract will involve significant risk being borne by the provider, with payments being linked to achievement of successful service outcomes, with staged payments. Throughout Q1 of the 2019/202 financial year the contracting authority presented the remission service concept to a number of its current and potential providers/suppliers. Market research was completed through a series of meetings, presentations and some cost-modelling workshops. The service specification was benchmarked against supplier capabilities and the ROI for the local health economy. As a consequence the risk-share/gain-share model proved unattractive to the providers/suppliers given that they would carry all the up-front operational costs and the return would be in the form of verified but deferred medicines savings. The provider being awarded the contract is the only organisation accepting the risks and able to technically deliver a viable service to meet the specified requirements of the contracting authority in terms of pace, approach and affordability.
IV.1.11) Main features of the award procedure:
The contract is being directly awarded to a single provider assessed to be the only organisation with sufficient appropriate capability to deliver at pace and scale this innovative healthcare intervention service.
