The procurement falls outside the scope of application of the Directive

Explanation:

Coronavirus Disease (COVID-19) is an infectious disease caused by a newly discovered coronavirus. The advice from the World Health Organisation suggests that most people infected with the COVID-19 virus will experience mild to moderate respiratory illness and recover without requiring special treatment. Older people and those with underlying medical problems like cardiovascular disease, diabetes, chronic respiratory disease and Cancer are more likely to develop serious illness.

As part of the COVID response to be prepared, plans were agreed with the Welsh Government, Health Board, Councils and the Welsh Rugby Union to secure the Principality Stadium in the Cardiff City Centre to transform the space into a temporary Field Hospital that could accommodate up to 2000 additional beds for COVID 19. The hospital’s aim was to treat Covid-19 patients who did not require critical care, beginning with those who are recovering yet cannot be discharged home at present. The Field Hospital was named officially as the Ysbyty Calon Y Ddraig (Dragon’s Heart Hospital) and is the largest temporary hospital in Wales and the second largest in the UK.

As the Health Board is due to return the Dragon’s Heart Hospital to the Principality Stadium at the end of October, ES Global are currently in the process of undertaking the urgent specialist decommissioning construction requirements and there would be significant risk for another provider to complete the final phase of this contract in terms of both time, cost and confusion caused from potentially two suppliers on the one site in any phased handover.

Based on this, the Health Board is issuing a VEAT for the continuation of the current contract to complete the decommissioning phases.

NHS Wales Shared Services Partnership on behalf of Cardiff and Vale University Local Health Board will allow a minimum 10 calendar day standstill period between notifying the award decision and awarding the contract. Should additional information be required it should be requested of the addressee in section I.1. Aggrieved parties who have been harmed or are at risk of harm by breach of the procurement rules have the right to take action in the High Court (England and Wales). Any such action is subject to strict time limits in accordance with the Public Contracts (Amendments).
