Section IV: Procedure
IV.1) Description
IV.1.1) Type of procedure
Award of a contract without prior publication of a call for competition
Justification for selected award procedure:
The procurement falls outside the scope of application of the Directive
Explanation
Oracle database and application licences are perpetual and our commitment with Oracle holds for as long as we are using the licences themselves. They carry commitments which mean that if we are actively using them then we must purchase additional licences and support from Oracle direct in this instance. This partly due to the dynamic nature of the changes to university HESA figures; it is not possible to enter into a framework or otherwise “compliant” purchase as we cannot predict the future need, and existing framework or tender cannot be completed for a custom requirement from a sole vendor.
