Abstract

This service is for the provision of an occupational physiotherapy service for approximately 4,400 Council employees, delivering assessment, treatment and rehabilitation to support employee wellbeing, reduce sickness absence and facilitate return to work.

This contract may be utilised by other Contracting Authorities (public sector bodies) that have an agreement with the Council through a Service Level Agreement (SLA). These may include but are not limited to schools, academies and tenant management

organisations (as listed in additional information below). Services will be provided to Employees in these Contracting Authorities; however, the Contract will continue to be managed by the Council. Orders will be raised and invoices paid by the City of Wolverhampton Council.

The list of Third-Party Organisations will be subject to change throughout the duration of the Contract and will be notified to the provider via a deed of Variation, annually. The existing list of known contracting authorities (via agreed SLA) are appended to the contract - Annex 1 - which are subject to change prior to initial contract execution.

The service provides occupational physiotherapy and musculoskeletal absence management services for Council employees, including remote and face-to-face assessments, treatment and rehabilitation, fast-track access to urgent appointments, workplace assessments, health and wellbeing initiatives, and virtual physiotherapy support to promote recovery, employee wellbeing and timely return to work.

The Council intends to award a contract to the existing provider following Direct Award Process C under the Health Care Services (Provider Selection Regime) Regulations 2023, having determined that the existing provider satisfies the relevant criteria and is capable of continuing to deliver the service to the required standard.

The approximate lifetime value of the contract is approximately £310,000 (exclusive of VAT). The contract is intended to commence on 01 October 2026 and continue until 30 September 2031 including optional extension period of two years.

This is a Provider Selection Regime (PSR) intention to award notice. The awarding of this contract is subject to the Health Care Services (Provider Selection Regime) Regulations 2023. For the avoidance of doubt, the provisions of the Public Contracts Regulations 2015 do not apply to this award. The standstill period begins on the day after the publication of this notice. Representations by providers must be made to the relevant authority by 23 September 2026. This contract has not yet formally been awarded; this notice serves as an intention to award under the PSR

VI.3) Additional information

In reaching its decision, the Council considered all five key criteria under the Provider Selection Regime. Particular emphasis was placed on Quality and Innovation, Value, and Integration, Collaboration and Service Sustainability, as these criteria were considered most relevant in assessing whether the existing provider is likely to continue delivering a high-quality, effective and sustainable occupational physiotherapy service throughout the proposed contract term. Improving Access, Reducing Health Inequalities and Facilitating Choice, and Social Value were also considered as part of the overall assessment. Whilst these criteria remained important, certain aspects were less directly applicable given that the service is provided exclusively to Council employees rather than the wider population.

The assessment found that the existing provider consistently meets contractual requirements and performance expectations, with extensive evidence demonstrating positive employee outcomes, service quality, and continuous improvement. The provider has established effective working relationships with Human Resources, managers and Employees, as well as complementing the Council's existing Occupational Health, Employee Assistance Programme (EAP) and wider wellbeing provision. Through early intervention, treatment, rehabilitation and workplace advice, it forms an integral part of the Council's preventative approach to workforce health and wellbeing, helping employees access the right support at the right time. No significant performance concerns, complaints or service delivery issues were identified.

The Council also concluded that the service continues to provide strong value for money when considering both cost and wider organisational benefits. Evidence considered included the service's contribution to reducing the financial burden associated with ill-health and musculoskeletal absence, benchmarking against comparable physiotherapy services provided by other local authorities and public sector organisations, and a desktop review of local market and wider UK physiotherapy market data.

The assessment also considered the costs and benefits of maintaining the existing arrangement over the proposed contract term, including the avoidance of implementation and mobilisation costs, continuity of service delivery, reduction of service disruption risks, preservation of employee satisfaction, and cost certainty over the life of the contract. Collectively, this evidence demonstrated that the existing provider continues to deliver a cost-effective service that supports positive workforce outcomes and represents value for money.

Having considered the evidence against all five key criteria, the Council concluded that the existing provider continues to satisfy the current contract, is likely to satisfy the proposed contract to a sufficient standard, and that the proposed contracting arrangements are not changing considerably. The Relevant Authority therefore intends to award the contract to the existing provider under Direct Award Process C.

The standstill period requirements, including for the reviewing of decisions, are detailed in Regulations 12 and 14(3). Provision for independent expert advice is set out in Regulation 23.

Providers may make a representation to the relevant authority within the first eight working days (14 September 2026 - 23 September 2026) following the start of the standstill period (i.e., eight working days starting with the first working day following the day after the intention to award notice has been published). Providers cannot submit a representation after that period, even if the standstill period has been extended in response to a representation from another provider.

Any provider wishing to make representations in accordance with Regulation 12 of the Health Care Services (Provider Selection Regime) Regulations 2023 should submit them in writing to Corporate.Procurement@wolverhampton.gov.uk before the end of the standstill period.

Relevant authorities are only obliged to respond to representations that meet all the following conditions:

* the representation comes from a provider that might otherwise have been a provider of the services to which the contract relates

* the provider is aggrieved by the decision of the Council

* the provider believes that the Council has failed to apply the regime correctly and is able to set out reasonable grounds to support its belief

* the representation is submitted in writing (which includes electronically) to the Council within eight working days of the start of the standstill period.

If a provider remains unsatisfied about the response given by the Council to their representations, then that provider may seek the involvement of the Independent Patient Choice and Procurement Panel.

If a provider wishes to request the panel to consider their representation further, then they must submit their request through the panel's website (find address below) within five working days of receiving the relevant authority's decision following the relevant authority's review of their representation.
