Justification for selected award procedure:
The procurement falls outside the scope of application of the Directive
Explanation
The Contracting Authority has elected to award without prior publication in accordance with Directive 2014/24/EU and in particular Regulation 32(2)(b)(iii) of the Public Contract Regulations 2015 as the supplier is the sole operator approved to provide maintenance for this equipment. The supplier does not authorise any third parties in the UK for this service.
The Contracting Authority believes there is no reasonable alternative given that the supplier acts as the sole and exclusive trader in the UK and does not authorise any third party suppliers. The decision to use "Beckman Coulter" is not as a result of the Contracting Authority artificially narrowing down the criteria of the procurement process such that no other economic operator could bid for the contract.
