II.2.4) Description of the procurement

The Council uses Oracle ERP software to manage business critical functions including but not limited to HR, Financial systems and procurement. This ERP system has been embedded throughout the Council since 2008 and is used on a daily basis. The current version of Oracle is not future proofed and will go out of Oracle support by December 2021.After a review of the marketplace for comparable services, the Council has determined that an award under Regulation 32 is justifiable as there are no other identified operators that have the ability to access oracle owned I.P.R. relating to security patches and updates and to apply these to maintain security.

Therefore, the Council deems that Regulation 32 (2) (b) (ii) “competition is absent for technical reasons” and (iii) “ protection of exclusive rights, including intellectual property rights" applies to this procurement due to the lack of effective competition in the marketplace for oracle products.

The procurement falls outside the scope of application of the Directive

Explanation:
