Justification for selected award procedure:
The procurement falls outside the scope of application of the Directive
Explanation:
Pegasus Developments Limited has a legal interest in the land on which the proposed development will take place. Without the land in question, the scheme cannot realistically progress. Pegasus Developments also has planning consent for the aforementioned properties. It is impractical for any other developer to carry out the works. It is therefore proposed to make this award without opening up the project for open competition.
The Council has however employed cost consultants to ensure that value for money is achieved on the project. It will also be subject to cost scrutiny and value for money assessment by the Council.
