1. Background
Beacon Foods Ltd is a privately-owned family business based in the heart of the Brecon Beacons, Wales. We prepare all our produce at our fabulous 36,000 square foot British Retail Consortium Grade AA factory. We are passionate about sourcing and preparing the most delicious foods that the culinary world has to offer, from raw ingredients to expertly finished ready-to-eat products.
We supply our specialist cooked ingredients inclusive of roasted, flame-grilled, caramelised, boiled or steamed to major food manufacturers, food service industries, and small independent companies across the UK. We are ambitious for our future growth.
This procurement process will utilise the Sell2Wales portal and Beacon Foods will follow its policies and procedures to ensure a fair and equitable process, whilst ensuring best value for Beacon Foods. This process is not subject to public procurement regulations.
The construction site will be accessed via the existing factory site roads and access points which must be kept clear at all times. The successful bidder will form their own secure construction site with access and egress controlled by the successful bidder at all times. Parking of construction vehicles will be limited and will need to be agreed with the client.
The successful bidder must not use the site for any purpose other than carrying out the works and will be required to complete one phase of the works before commencing the second phase, please note that the order of completing the phase of works will need to agreed with Beacon Foods Ltd post award of tender.
The surrounding areas of the construction site is a live factory and other commercial buildings.
The successful bidder will take up the duties of Principal Contractor under the Construction, Design and Management Regulations 2015 and will be required to produce a Construction Phase Plan at least 1 week prior to any construction work is started on site and to submit that plan to the Principal Designer and Client being suitable and sufficient to comply with the regulations.
2. Scope of Procurement
Beacon Foods are seeking one contractor to design, supply and install full building and services installation at:

All items should be delivered to site, assuming Incoterm DDP (Delivered Duty Paid), installed and commissioned as per an agreed Design Specification. Cranes, lifting equipment and scaffolding for installation and commissioning should be included in Tender.
3. Indicative Programme
Below is the proposed procurement and project timetable. This is intended as a guide and, whilst Beacon Foods does not intend to depart from the timetable, it reserves the right to do so at any time.

4. Method of Tendering
Beacon Foods will follow its own policies and procedures to ensure a fair and equitable process, whilst ensuring best value for Beacon Foods. This process is not subject to public procurement regulations.
Beacon Foods Tendering Process for the procurement of goods or services that are or maybe subject to Government grant funding is as follows:
Step 1 : Beacon Foods will publish an Invitation to Tender (ITT) on Sell2Wales and/or send this ITT to potential bidders direct.
Step 2 : Tender should be submitted to Mr Mark Evans. Submissions must include the following :
• Detailed quotation
• Technical specification and drawings
• Daily rates for personnel supplied out of contract scope.
• Detailed Gantt project programme
• Completed Beacon Foods supplier questionnaires (Appendix 4 & 6)
• Completed Beacon Foods Ethical Trading supplier compliance questionnaire (Appendix 5)
Step 3: Beacon Foods will issue a receipt for tenders received. A tender submission will only be deemed received when a receipt is issued from Beacon Foods.
Step 4: Beacon Foods will review and evaluate the submissions as per the selection criteria described in this ITT.
Step 5: Following evaluation of the Tenders. Beacon Foods will award the contract in the form of JCT Intermediate Building Contract with contractors design 2016. The contractor and the reason for nomination will not be disclosed by Beacon Foods to all bidders.
The following terms should be adhered to as part of this tendering process:
A detailed quotation as per the layout in Appendix III must be submitted;
➢ A completed Beacon Foods health, safety & environment supplier questionnaire must be submitted as per Appendix 4;
➢ A completed Beacon Foods Ethical Trading supplier compliance questionnaire, as per Appendix 5 must be submitted with confirmation that Beacon Foods Policy on Ethical Trading is understood and accepted;
➢ Beacon Foods may disqualify any Bidder that does not submit a compliant tender response in accordance with the instructions of this ITT;
➢ Beacon Foods does not accept any costs by the bidder or its agents or sub contractors for the preparation of submission of their offer;
➢ Beacon Foods may annul or withdraw this ITT at any time, or re-invite tender responses on the same or alternative basis;
➢ Beacon Foods may choose not to award a contract for a particular component/service;
➢ Beacon Foods may modify the ITT in any respect, by way of clarification, addition, deletion or otherwise;
➢ Late clarifications may, at Beacon Foods discretion, be discounted from further consideration;
➢ Beacon Foods may make whatever changes Beacon Foods sees fit to the timeline, structure or content of the procurement process, approvals processes or for any other reason;
➢ Beacon Foods reserves the right to seek further information or evidence for the purposes of confirming or clarifying any aspect of the content of a Bidder’s Tender response;
➢ Beacon Foods does not bind itself to accept the lowest or any Tender and reserves the right to accept a Tender either in whole or in part, each item being for this purpose treated as Tendered separately;
➢ Beacon Foods reserves the right, at its absolute discretion not to accept part or all of any Tender submitted in response to this ITT;
➢ Any information or documents submitted in response to this ITT must relate to the Bidder that will enter into a contract with Beacon Foods if successfully awarded. Where a sub-contracting approach is proposed, all information requested should be given in respect of the prime contractor. Prior to submitting its Tender, it is the Bidder's responsibility to ensure that all proposed sub-contractors are fully aware of all the technical, commercial and legal requirements relating to this procurement
➢ All responses and submissions provided may form part of the contract should your organisation subsequently be successful. By submitting a response all Bidders warrant and represent that the information set out its Tender is true and accurate. If Beacon Foods becomes aware that the Bidder has submitted inaccurate information, then Beacon Foods reserves the right to disqualify the Bidder from the procurement process due to misrepresentation.
➢ Between the period of the tender being issued and submissions being made queries regarding the tendering process, tender content or request for additional information can be made in writing via Mr Jeff Davies. Beacon Foods will attempt to respond to queries as is reasonably practical. Queries and response will not be circulated to all bidders.
➢ Except for manifest error or as may otherwise be expressly agreed by both Beacon Foods and the Bidder, the contents of submitted Tenders will be deemed to be binding upon the Bidder and open for acceptance by Beacon Foods for a period of 60 days. Therefore, Bidders are cautioned to verify their proposals before submission to Beacon Foods.
➢ Each Bidder shall be solely responsible for all the costs it incurs in the preparation and submission of its Tender up to and including the award of any contract by Beacon Foods. This shall also be deemed to cover the cost of attending any pre-or post-award Bidder meetings and site visits. Beacon Foods shall in no event be responsible or liable for any such costs regardless of the conduct or outcome of the Tender process, and in this respect, the Bidder shall have no recourse to Beacon Foods.
➢ Late or unsigned submissions may not be considered.
➢ Beacon Foods will issue a receipt of received submissions until a receipt is issued a submission is not deemed to have been received.
➢ Beacon Foods expressly reserves the right to require a bidder to provide additional information supplementing or clarifying any of the information provided in response to invitation to tender (ITT).
➢ Beacon Foods may seek independent financial and market advice to validate information declared, or to assist in the evaluation.
➢ The ITT is issued on the basis that nothing contained in it shall constitute an inducement or incentive nor shall have in any other way persuaded a Tenderer to submit a Tender or enter into any contractual agreement
➢ Any Bidder who directly or indirectly canvasses any employee, or agent of Beacon Foods concerning the award of the Contract and/or the process leading to that award or after the Contract is awarded will be disqualified or Beacon Foods will be entitled to terminate the contract.
➢ This tendering process and subsequent contract are not subject to public procurement regulations
➢ Beacon Foods reasoning for awarding or rejecting tenders will not be communicated.
➢ All tender responses will be treated confidentially by Beacon Foods.
5. Selection Approach
Beacon Foods will review and evaluate Tender submissions as per the criteria listed in the table below which is not an exhaustive list and other aspects of tender submissions may be considered.
Any bidders whose application does not meet one or more Pass/fail criteria may be rejected.
Weighting and scoring of selection criteria and reasoning for selection will not be advised by Beacon Foods to those who are successful or unsuccessful at any stage of this tender process.

6 project assumptions
Beacon Foods are seeking one contractor to deliver the full scope of works detailed in this invitation to tender. The successful contractor will be required to complete one phase of the works before commencing the second phase, please note that the order of completing the phase of works will need to agreed with Beacon Foods Ltd post award of tender.
Scope as per the main specification document in Appendix I, and the accompanying drawings and documents in Appendix 2. The following details are additional information and corrections to the appendix, and the following point supersede any information shown in the appendix documentation.
The following should also be assumed as part of the costs presented:
• Supply of access and lifting equipment, including but not exclusive to Cranes and scaffolding for installation and commissioning should be included in Tender;
• To act as Principle Contractor under the Construction, Design & Management Regulations ensuring all duties of a Principal Contractor is carried out including but not limited to that a comprehensive Construction Phase Plan is produced prior to any works being carried out on site and to control the safety arrangements of the construction site throughout the construction phase.
• Provide all required information for the Health & Safety File including but not limited to information about the structure or materials used, maintenance and cleaning requirements, alteration, refurbishment and demolition considerations. Prepare details of construction materials and methods, as built drawings, utilities and services and residual hazards.
• All travel, board, lodgings and expenses incurred by the bidder, its employees or contractors, to submit the tender, or complete the obligations as per this ITT and subsequent contract should be borne by the bidder and included in the quoted price.
• Complete set of building operating and maintenance manuals in English, one hard copy and one electronic copy that will be provided at the end of installation to support operator training and ongoing operation. The contents should include but not be limited to description, consultants and designers’ details, copies of any consents and approvals, building regulations certification, maintenance requirements, operational requirements, fire safety including
drawings showing fire appliance routes, emergency escape routes, fire resistant doors and materials, location of emergency and fire fighting systems, services isolation and the like. Detailed descriptions of materials used with information pertaining to repair and maintenance.
• Training is to be provided on site at Beacon Foods
• Provision of welfare facilities to be provided by the successful contractor, Beacon Foods facilities will not be accessible.
• All necessary Personal Protective Equipment (PPE) as necessary to safely complete tasks.
• Waste generated as part of project should be segregated and removed using registered waste carrier, recycling, reusing where possible to reduce Environmental impact. Paperwork and certification to support Environmental audit is to be provided.
• Minimum £10m public liability and employer’s liability insurance for both on site works at Beacon Foods as well as for equipment in transport, delivery and storage. Minimum Professional Indemnity cover of £5m to cover design portion of the works. Beacon Foods will provide insurance cover for the works.
• The works will be warranted to be free from defects in workmanship, materials and design for 12 months from the date that handover.
• Invoices will be paid 30 days from end of month submitted at agreed milestones.
• A detailed Gannt should be supplied as part of the tender,
• The detail in this ITT should form the basis of the bidder’s tender in conjunction with the JCT Intermediate Building Contract with contractor’s design 2016.
• Successful Bidder will be held accountable for compliance with any standards not mentioned, but which are required by law.
• The ITT and all subsequent contracts are Governed by Laws of England and Wales.
• Attendance at daily, weekly and monthly project meetings ensuring representative is of enough status and knowledge of the works so as to provide detailed progress reports and deal with matters arising.
• In addition to constant management and supervision of the works provided by the contractor’s person in charge, all significant types of work must be under close control of competent trade supervisors to ensure maintenance of satisfactory quality and progress. Give maximum possible notice and a minimum of 1 week before person in charge of the site works is changed.
• Day works must not be commenced unless authorised in writing by Beacon Foods Project Manager before any day works are commenced.
• The successful contractor shall be solely responsible for setting out the works, all levels and dimensions.
• The works must at all times and on completion comply with all relevant UK regulations including but not limited to Water regulations and byelaws, Electrical Regulations, Building Regulations and Environmental Regulations.
• Give at least 2 days’ notice to Beacon Foods before removing scaffolding or other facilities for access to enable inspection.
• Allowance for all temporary works that may be required.
• Detailed quotation should be made in British Pounds.
The project will be considered completed when the following project deliverables have been met:
• Installation has been completed, all snagging and defects are rectified all power energized.
• Building conforms with all building regulation requirements.
• Test Certificates issued for every electrical circuit.
• Manuals/Drawing and training have been provided.
• Building is constructed in accordance with approved panning drawings.
7 Health & Safety and Environmental Aspects
This system will be installed at Beacon Foods, Brecon in the UK and therefore subject to UK legislation and codes of Practice, the list below us for assistance and not exhaustive:
The successful bidder will take the role of the Principle Contractor and must support Principle Designer and Client to meet their obligations, and specifically will be expected to provide:
• Suitable and sufficient RAMS to be issued for each activity prior to the commencement of each activity and are available for review by Beacon Foods if requested.
• Trained personnel and written evidence of competence.
• Induction training carried out for each employee, contractor and visitor employed to fulfil.
• Compliance with Beacon Foods site safety rules.
• Adequate security of the works to prevent unauthorised access.
Project risks to be identified, eliminated, reduced or controlled as per the Construction (Design and Management) Regulations 2015.
Provision of welfare facilities with be provided by the successful bidder acting as principle contractor. Beacon Foods facilities will not be accessible.
All necessary Personal Protective Equipment (PPE) as necessary to safely complete tasks.
Comply with the requirements of relevant national and local environmental legislation.
Protect against spillages or contaminations to foul and surface water drains ensuring continuity of service throughout.
Ensure services to adjacent areas and neighbours are maintained or at least 24 hours’ notice is provided of interruption.
Beacon Foods Contractor Health and Safety Pack and site safety rules are adhered to as per appendix 6.
All personnel working on the project will be able to converse fluently in spoken and written English.
The successful bidder must not employ or appoint a person to work on Beacon Foods site unless that person has the necessary skills, knowledge, training and experience to carry out the tasks allocated to that person in a manner that secures the health and safety of any person working on the site. Health and safety training records should be obtained including safety supervision training for site managers and site operatives.
The works supplied must consider at the design phase :
• Emissions to water, air or land
• Energy efficiency: Take appropriate measures to ensure that energy is used
efficiently in the activities
• Odour Emissions: The activities shall be free from odour at levels likely to cause pollution outside the site and should include an odour management plan to prevent or where that is not practicable to minimise the odour.
• Noise and vibration: Emissions from the activities shall be free from noise and
vibration at levels likely to cause pollution outside the site and should include a noise and vibration management plan to prevent or where that is not practicable to minimise the noise and vibration, within acceptable limits.
• Pests: The activities shall not give rise to the presence of pests which are likely to cause pollution, hazard or annoyance outside the boundary of the site
• BAT (Best Available Techniques) should be used to minimise the environmental impact of this installation.
