Abstract

Swansea Council (the Council) invites tenders for inclusion onto a Framework Agreement of educational providers for pupils who are educated within Swansea Pupil Referral Unit (PRU). Swansea PRU caters for pupils aged from 5 – 16. In its secondary provision, it serves to support young people aged 11-16 who are not educated in Schools. The pupils who attend the PRU have severe and complex needs and can be highly challenging pupils in terms of their behaviour and attitudes to learning. The aim of the framework is to provide additional curriculum and vocational support for pupils in the secondary phase of Swansea PRU. These include pupils who are aged from 13 – 16 and who represent some of the most challenging young people in the Authority; in order to nurture a positive experience of full-time education by developing a unique programme of support bespoke to each young person. This bespoke package will include varying amounts of academic content provided by teachers based at Swansea PRU combined with a vocational provision provided by the successful providers. The programmes have each young person’s interests and needs at their centre. The Services to which this Notice relates fall within the Regulation 74 of the Public Contracts Regulations 2015 (Regulations). Although the Contracting Authority may voluntarily adopt certain provisions. Although the Contracting Authority may voluntarily adopt certain provisions in the Regulations neither the employment of any particular terminology nor any other indication shall be taken to mean that the Contracting Authority intends to hold itself bound by any of the Regulations save those applicable to services falling within Regulation 74. Bidders should note that they will be required to enter into terms and conditions of contract as set out in the tender documents and that save for matters of clarification or consistency the Contracting Authority will not negotiate the terms.

1. Register your company on the eTenderWales portal (this is only required once):

— Click the “ITTs Open to All Suppliers” link (these are the ITTs open to any registered supplier).

— Click on the relevant ITT to access the content.

— Click the “Express Interest” button in the “Actions” box on the left-hand side of the page.

— This will move the ITT into your “My ITTs” page (this is a secure area reserved for your projects only).

— Click on the ITT code. You can now access any attachments by clicking the “Settings and Buyer Attachments” in the “Actions” box.

3. Responding to the invitation to tender:

— You can now choose to “Reply” or “Reject” (please give a reason if rejecting).

— You can now use the “Messages” function to communicate with the buyer and seek any clarification.

— Note the deadline for completion, then follow the onscreen instructions to complete the ITT.

Precise information on deadline(s) for review procedures:

The Council may incorporate a voluntary minimum 10 calendar day standstill period at the point information on the award of the contract is communicated to tenderers. This period will extend to 15 calendar days for communication by non-electronic means. Applicants who are unsuccessful shall be informed by the Council as soon as possible after the decision has been made. Should additional information be required it should be requested of the addressee in section I.1. If an appeal regarding the award of the contract has not been successfully resolved, The Public Contracts Regulations 2015 provide for aggrieved parties who have been harmed or are at risk of harm by breach of the rules to take action in the High Court (England, Wales, and Northern Ireland). Any such action must be brought promptly (generally within 30 days). Where a contract has not been entered into, the Court may order the setting aside of the award decision or order the Council to amend any document and may award damages. If the contract has been entered into the Court may, depending on the circumstances, award damages, make a declaration of ineffectiveness, order the Council to pay a civil financial penalty, and/or order that the duration of the contract be shortened. If a declaration of ineffectiveness is sought, any such action must be brought within 30 days where the Council has communicated the award of the contract and a summary of reasons to tenderers, or otherwise within 6 months. The purpose of the standstill period referred to above is to allow the parties to apply to the Courts to set aside the award decision before the contract is entered into.
