The procurement falls outside the scope of application of the Directive
Explanation:
This arrangement is in accordance with Regulation 12(7) of the Public Contract Regulations (2015) which allows Natural Resources Wales and the Welsh Government to work collaboratively under a public sector-to-public sector agreement. The requirements stated in Recital 33 of the Public Contracts Directive 2014 have also been considered.
Welsh Government are lease holders of a space in the Mitel Data Centre, we then sub-lease a section of this and are therefore charged by Welsh Government for the rental and the electricity charges.
