The works, supplies or services can be provided only by a particular economic operator for the following reason: protection of exclusive rights, including intellectual property rights

Explanation

WAST made a capital purchase of CSAM Optima’s ambulance simulation software in 2015. CSAM Optima own the intellectual property

rights to the Optima software and are the only company that can maintain this specific software. Further, WAST has the option of training

to support in-house analysts to use the software or embedded analysts. Again, because CSAM Optima own the intellectual property rights

to the software, they are the only company that can provide this training or the embedded analysts.
