II.1.4) Short description
Four second-generation Shoreline Management Plans (SMPs) were developed between 2006
and 2012 for the coastline of Wales (including cross border locations with England) in accordance
with Defra guidance of 2006. These documents are owned by four respective Coastal Groups,
adopted by each Local Authority and received Welsh Government Flood and Coastal Erosion
Risk Management Branch (WG) approval in late 2014.
This contract is required following the instruction from WG in their FCERM remit letter to Natural
Resources Wales (NRW) of June 2020 to ‘Liaise with the Environment Agency and lead on
extending the Shoreline Management Plan (SMP) portal and refresh to all four Welsh SMP areas’.
As in England, this contract is not a request to, nor a commitment to, undertake a 3rd edition of
SMPs but to produce an evidence based review of SMP implementation to date.

The need to deliver this Shoreline Management Plan (SMP) Refresh purchase is documented within Welsh Government’s (WG) Flood and Coastal Erosions Risk Management (FCERM) remit letter to NRW for the current financial year of 2020/21. Likewise, this purchase is also noted in paragraph 190 of WG’s revised National FCERM Strategy for Wales published on Tuesday 20th October 2020.
Work Package 1 comprises the production of a stand-alone Supplementary Guidance Document on SMPs in MS Word and PDF form for Wales to sit alongside Defra’s original SMP Guidance of 2006 used in England and Wales. This will capture present evidence, policy and strategy changes etc since 2006 in Wales that bear direct relevance to coastal risk management and the onward implementation of SMPs in Wales.
Work Package 2 comprises the production of technical ‘Health Check’ reports for each of the four SMPs in Wales. Production will require consultation with Coastal Groups (on which NRW are represented) who are owners and responsible for implementation of the SMPs (their policies and associated action plans) and serve to capture what has and hasn’t worked well to date since SMP publication, what could be done to improve future implementation and the creation of recommended next steps for the short and long-term.

Award of a contract without prior publication of a call for competition
Justification for selected award procedure:
The procurement falls outside the scope of application of the Directive
Explanation:
This arrangement is in accordance with Regulation 32(b)(ii) of the Public Contract Regulations (2015) which allows for the negotiated procedure without prior publication to be used for public works contracts, public supply contracts & public service contracts where (b) the works, supplies or services can be supplied only by a particular economic operator due to (ii) competition being absent for technical reasons.
This is a replication of a service that was recently completed (August 2020) by Jacobs & RHDHV in partnership for the EA as Phase 1 of the SMP Refresh project in England. The current SMPs were created in 2006-2012 using Defra guidance of 2006 for a suite of consistent SMPs across England & Wales. It is therefore essential that the same SMP Refresh approach is now undertaken for Wales to ensure consistency of approach particularly for the two cross-border SMPs.
The supplier authored 3 of the 4 current SMPs in Wales which places them in a unique position possessing extensive technical knowledge of Welsh SMP content & coastal risk management issues in Wales. The supplier devised an innovative & bespoke methodology in delivering the SMP Refresh project in England. This bespoke methodology included: collation of data, evidence, policy, legislation that currently impacts SMP delivery; tailored engagement exercises with all key stakeholders to ascertain their experiences of SMP implementation & specifically their successes & lessons learnt to date; identification of challenges & barriers limiting implementation to date, &; resulting creation of new Supplementary Guidance for SMPs & technical & evidence-based recommendations to improve future SMP implementation (‘SMP Health Checks’).
Strategically, the two cross-border Wales-England Coastal Groups (namely the ‘Severn Estuary’ & ‘North Wales North West England’ Coastal Groups) have participated extensively in the English SMP Refresh process for English portions of the respective cross-border SMPs. Coastal Group members have: built professional rapport with the supplier’s project team; familiarised themselves with thebespoke methodology applied by the supplier; praised the supplier’s delivery approach, &; recognised the value served by the supplier’s outputs in helping prioritise their Coastal Group future work programmes in an evidence-based fashion. Continuity of approach to the SMP Refresh project in Wales is essential strategically.
